SB 216 Summary

• Video service providers holding a certificate of franchise authority from the Indiana Utility Regulatory Commission (IURC) or an unexpired local franchise issued before July 1, 2006, are prohibited from paying franchise fees to local units for any calendar quarter or reporting period beginning after June 30, 2010.

• Providers continuing under local franchises issued before July 1, 2006, must pay franchise fees only for reporting periods beginning before July 1, 2010, and may not be required to pay fees for periods after that date regardless of local franchise terms.

• Sections 23 and 24 of IC 8-1-34 (governing gross revenue calculations and franchise fee payments) expire January 1, 2012.

• The bill corrects a federal law citation reference from 43 U.S.C. to 47 U.S.C. section 542(c) regarding franchise fee pass-through to subscribers.

• Effective July 1, 2010.
