Senate Bill No. 255 Summary

• Establishes an exception allowing the Department of Natural Resources to sell excess nursery stock determined after January 2 of each year.

• Grants the department authority to set prices for excess nursery stock sales, with prices for out-of-state sales required to be at least two times higher than in-state prices.

• Maintains existing restrictions preventing sales to out-of-state individuals (unless they own Indiana land and certify stock will be planted there), retail businesses, and wholesale businesses.

• Effective July 1, 2010.
