Employees of political subdivisions are automatically considered to have resigned from employment if they assume an elected executive office or become an elected member of the legislative body of the same political subdivision that employs them

The restriction does not prevent employees from holding elected office in a different political subdivision than the one that employs them

Current government employees holding elected office as of June 30, 2010 are grandfathered in, but the new rules apply if they assume office again after that date

The bill amends multiple Indiana Code sections covering city employees, county police officers, safety board members, and fire department personnel to make their political participation rights subject to the new resignation requirement

Effective date: July 1, 2010
