Amends Indiana Code 36-8-10-23 to require a minimum 1% annual cost of living adjustment (COLA) for sheriff's pension benefits, effective July 1, 2010.

Applies only to counties that adopt the provision by ordinance of the county fiscal body.

Establishes that annual COLA adjustments must be at least 1% but cannot exceed 3%, calculated based on the Consumer Price Index.

Applies to retired or disabled employee beneficiaries who are at least 55 years old and surviving spouses.

Excludes COLA provisions from collective bargaining agreements and related negotiations.
