SB 285 Summary

• Requires the attorney general to enter into a memorandum of understanding with an entity to establish a statewide pseudoephedrine (PSE) tracking system by July 1, 2010.

• Limits sales of ephedrine or pseudoephedrine to 3.6 grams per individual per day or 9 grams per individual per 30-day period, effective January 1, 2011.

• Mandates retailers electronically transmit purchaser information (name, address, product name, quantity) to the PSE tracking system before completing sales, with a 180-day implementation deadline.

• Establishes that the PSE tracking system must issue a stop sale alert if a transaction would violate state or federal quantity limits, and prohibits completion of sales when alerts are triggered.

• Directs the pharmacy board to adopt rules and procedures regarding pharmacies that violate PSE tracking requirements.
