SB 302 Summary

• Requires sellers of prepaid wireless telecommunications service to collect an enhanced prepaid wireless charge at the point of sale not to exceed 50% of the monthly wireless emergency enhanced 911 fee.

• Sellers must remit collected enhanced prepaid wireless charges to the wireless enhanced 911 advisory board for deposit in the wireless emergency telephone system fund.

• Sellers may retain 1% of collected charges to reimburse direct costs of collection and remittance; consumers are exempt from the charge if they are the federal government or a federal agency.

• Establishes that enhanced prepaid wireless charges are not subject to state or local taxation and are not considered additional wireless 911 service fees.

• Effective July 1, 2010; changes terminology from "subscriber" to "user" throughout related wireless 911 fee statutes.
