Requires the Office of Medicaid Policy and Planning to apply to the federal government by June 1, 2010 for an amendment allowing Medicaid recipients to elect a "pay-in option" for the state's income spend down program

The pay-in option allows Medicaid recipients to satisfy spend down requirements by paying the spend down amount directly to the state each month, rather than accumulating medical expenses

Implementation of the amendment is contingent on federal approval, with the office required to file an affidavit with the governor within 5 days of receiving approval from the U.S. Department of Health and Human Services

Repeals the existing noncode provision (P.L.23-2006, Section 1) that previously made the federal application permissive rather than mandatory

Declared an emergency measure, making the law effective immediately upon passage
