Grants area agencies on aging flexibility to manage program funding and prohibits the division of aging from imposing restrictions beyond those in contracts with agencies

Allows spouses and parents of individuals at risk of institutionalization to provide attendant care services for Medicaid reimbursement, capped at 8 hours per day and 5 days per week

Requires hospitals, nursing facilities, and area agencies on aging to provide patients with contact information for local agencies, lists of all available long term care options, and disclosure of any financial interests hospital representatives have in recommended facilities

Prohibits hospitals from discharging patients to nursing facilities in which the hospital, its governing board, executives, or staff physicians have a financial interest without patient consent, and authorizes the division of aging to charge hospitals for costs of correcting inappropriate placements

Creates presumptive eligibility process allowing area agencies on aging to immediately begin Medicaid aged and disabled waiver services for applicants who meet medical eligibility requirements and are at risk of institutionalization
