Senate Bill 362 Summary

• Deletes provisions requiring a petition and voter referendum to remove municipally owned utilities from Indiana Utility Regulatory Commission (IURC) jurisdiction.

• Allows municipal legislative bodies to remove utilities from IURC jurisdiction through ordinance adoption alone, effective 60 days after ordinance passage.

• Applies to water utilities in second class cities, third class cities, and towns.

• Requires municipal legislative bodies to provide 30 days' written notice to ratepayers and the IURC before final vote, with second class cities needing two public meetings in different locations.

• Effective July 1, 2010.
