SB 385 Summary

• Makes it a Class B misdemeanor for alcohol permittees or their employees/agents to sell carryout alcoholic beverages without first requiring proof of age 21+ via driver's license, government-issued ID card, or government-issued document bearing photograph and birth date.

• Provides an affirmative defense if the purchaser appeared to be more than 50 years of age.

• Requires permittees selling carryout alcohol to post a sign at least 8.5" by 11" in visible location stating "STATE LAW REQUIRES IDENTIFICATION FOR SALES OF ALCOHOLIC BEVERAGES FOR CARRYOUT" in at least 20 point type.

• Adds government-issued documents bearing photograph and showing age 21+ as an acceptable proof defense in criminal prosecutions or proceedings before the alcohol and tobacco commission for furnishing alcohol to minors.

• Effective July 1, 2010.
