Senate Enrolled Act No. 401 Summary

• Expands the definition of "owner of property" to include mobile homes and manufactured homes assessed as personal property and used as a principal residence with standard property tax deductions, in addition to real property owners.

• Modifies petition and remonstrance processes for controlled projects by allowing both registered voters and property owners (including mobile and manufactured home owners) to initiate or object to proposed debt service or lease payments.

• Clarifies that persons can sign petitions or remonstrances only once regardless of owning multiple parcels of real property, mobile homes, or manufactured homes, or holding multiple qualifying statuses.

• Requires school corporations to send certified copies of resolutions to the department of local government finance in addition to the county auditor when transferring or reimposing tax levies.

• Effective date: July 1, 2010.
