HB 1026 Summary

• Creates a rebuttable presumption that courts must order child transfers between parents occur at a neutral location (not either parent's residence) when both parents participate in the transfer and one or both have been arrested for or convicted of domestic violence.

• Defines "crime of domestic violence" for custody and juvenile law purposes by reference to IC 35-41-1-6.3.

• Applies to both custody determinations under IC 31-14-14 and juvenile proceedings under IC 31-17-2.

• Effective July 1, 2011.
