HB 1028 Summary

• Makes it a Class A misdemeanor for any person to require an individual to become or remain a member of a labor organization, or to pay dues, fees, or other charges to a labor organization, as a condition of employment.

• Voids any contract or agreement between a labor organization and employer that violates these requirements.

• Establishes a private right of action for employees who suffer injury from violations or threatened violations, allowing courts to award actual and consequential damages, civil penalties up to $1,000, attorney's fees, and injunctive relief.

• Allows employees to file complaints with the attorney general or county prosecuting attorney, who must investigate and enforce compliance.

• Applies to contracts entered into, modified, renewed, or extended after June 30, 2011, but does not affect agreements already in effect on that date.
