HB 1049 Summary

• Requires drilling operators performing hydraulic fracturing on Class II wells subject to the federal Underground Injection Control Program to submit an environmental compliance plan to the Department of Natural Resources for approval before proceeding.

• Environmental compliance plans must include well location and depth, injection fluids and propping agents, chemical constituents and additives used, geographic analysis of the well area, predrilling survey results, and analysis of potential water and land pollution in Indiana.

• Drilling operators must disclose all chemical constituents, additives, and wastes generated during hydraulic fracturing, except proprietary chemical formulas and trade secret chemicals may be withheld unless needed for medical emergency treatment.

• Department shall approve or disapprove environmental compliance plans based on criteria including compliance with the federal Safe Drinking Water Act and whether the hydraulic fracturing will pollute or endanger Indiana's water and land.

• Department shall publish disclosed chemical information on its website and may adopt rules to implement requirements, with periodic plan updates allowed; effective July 1, 2011.
