HB 1064 Summary

• Requires funeral directors and crematory authorities to make reasonable efforts within five business days to determine if a deceased person being cremated is a veteran, veteran's spouse, or veteran's dependent child.

• Allows funeral directors and crematory authorities to share cremated remains and deceased person information with the National Cemetery Administration or veterans organizations if the veteran status cannot be determined and there is no authorizing agent.

• Permits funeral directors to release unclaimed cremated remains of qualifying veterans or their spouses/dependents to veterans organizations for final disposition at state or national veterans' cemeteries after 90 days total (60 days initial hold plus 30 days notice period).

• Provides immunity from criminal and civil liability for funeral directors, crematory authorities, and veterans organizations complying with these provisions, except in cases of willful or wanton misconduct.

• Effective July 1, 2011.
