House Bill No. 1067 Summary

• Prohibits public works contract plans, specifications, and documents from requiring bidders, contractors, or subcontractors to enter into or comply with labor organization agreements.

• Prevents discrimination against bidders, contractors, or subcontractors for refusing to sign or comply with labor organization agreements on public works projects.

• Prohibits requiring employees to become members of labor organizations or pay dues/fees to labor organizations exceeding their share of collective bargaining, contract administration, or grievance adjustment costs.

• Establishes a cause of action allowing interested parties (bidders, contractors, subcontractors, employees, and taxpayers) to challenge contract awards that violate these provisions, with prevailing parties entitled to attorney's fees, costs, and void declarations.

• Applies to contracts entered into, awarded, or renewed after June 30, 2011, and does not interfere with rights protected under the federal National Labor Relations Act.
