HB 1070 Summary

• Child care centers licensed as comprehensive care facilities must make influenza immunizations available to employees with direct contact with children during October 1 through February 1 each year.

• Immunizations require employee consent and must follow recommendations from the CDC's Advisory Committee on Immunization Practices.

• Centers are not required to provide immunizations if vaccine supply is inadequate as determined by the department.

• Centers cannot require employees to receive flu shots if they have prior immunization documentation, the vaccine is medically contraindicated, it conflicts with religious beliefs, or the employee refuses after being informed of health risks.

• The division of family resources may adopt rules to administer the immunization requirements; effective July 1, 2011.
