House Bill 1080 Summary

• Prohibits health plan and HMO contracts from preventing providers from accepting patients who are insured by other carriers, Medicaid recipients, or Medicare recipients.

• Prohibits contracts from requiring providers to accept more patients than specified in the agreement, or if unspecified, more than the provider can accept without compromising patient care quality.

• Allows contracts to require providers to give at least 60 days' notice before ceasing to accept health plan patients and at least 30 days' notice before resuming acceptance.

• Applies to agreements and contracts entered into, amended, or renewed between insurers and providers and between HMOs and participating providers.

• Effective July 1, 2011.
