HB 1087 Summary

• Increases penalties for motor vehicle operation violations that result in injury, serious bodily injury, or death of another person, effective July 1, 2011.

• Elevates violations from Class C infraction to Class B infraction when resulting in death; adds new Class B misdemeanor offense to Class A misdemeanor when death results.

• Establishes mandatory driving privilege suspension recommendations: 30 days for injury, 90 days for serious bodily injury, and 180 days for death in most traffic violations.

• Applies enhanced penalties to reckless driving, aggressive driving, highway work zone violations, motorcycle lane violations, and tractor-trailer combination violations.

• Amends IC 9-21 and IC 9-30-13-1 to create tiered penalty structure based on severity of harm caused by motor vehicle operation violations.
