IN HB1133

Creates new chapter in Indiana Code establishing limited liability protections for agritourism providers for injuries or deaths resulting from inherent risks of agritourism activities, effective July 1, 2011.

Defines agritourism activities as recreational, educational, or entertainment activities at agricultural operations including farming, self-pick farms, animal exhibitions, hunting, fishing, hiking, and trail riding open to the general public.

Protects agritourism providers from liability for inherent risks including natural land conditions, animal behavior, equipment dangers, and negligent acts of participants who fail to follow instructions or heed warnings.

Requires agritourism providers receiving monetary compensation to either post a warning sign with one-inch black letters at the main entrance or obtain signed participant releases acknowledging the liability warning.

Preserves agritourism provider liability for known dangerous conditions not disclosed to participants, inadequate employee training, willful or wanton disregard for participant safety, or intentional injury.
