HB 1166 Summary

• Prohibits retailers and distributors from selling, reselling, distributing, or donating toys or child care articles that have been recalled due to federal lead paint limits under 15 U.S.C. 1278a(a)(2).

• Requires retailers and distributors to remove recalled products from availability within 24 hours of receiving notification of the recall from a court, regulatory body, manufacturer, distributor, or retailer.

• Subjects violators to the same penalties and legal actions as persons committing deceptive acts under Indiana Code 24-5-0.5.

• Provides an affirmative defense for consignment and resale shops if a recalled product has no identifying information or packaging on it, and requires these shops to make reasonable efforts to identify recalled products.

• Effective July 1, 2011.
