IN HB1181

Amends the definition of "mortgage" in Indiana Code 32-30-10.5 to exclude land contracts and specify that the term includes a first lien on residential real estate upon which a dwelling is constructed or intended to be constructed.

Requires creditors filing residential foreclosure actions after June 30, 2011 to include the debtor's most recent contact information with the complaint, including all telephone numbers, electronic mail addresses, and any mailing address other than the mortgaged property address on file.

Maintains existing requirements for creditors to send a pre-suit notice to debtors at least 30 days before filing foreclosure and to include a notice of settlement conference rights with the complaint.

Effective July 1, 2011.
