HB 1194 Summary

• Allows the alcohol and tobacco commission to issue retailer permits to restaurants in economic development areas, redevelopment project areas, urban renewal areas, or redevelopment areas without being subject to quota restrictions.

• Requires applicants to either expend at least $75,000 over five years for renovation of the restaurant building, or commit to a $75,000 capital investment that is completed before the permit is issued.

• Establishes that licensed premises must be open to the public at least 10 hours daily, 5 days per week, and have a seating capacity of at least 50 persons.

• Sets the initial permit fee at $50,000 and renewal fee at $1,000; permits cannot be transferred to another location.

• Requires applicants to demonstrate they attempted to obtain a quota-restricted permit within the municipality and that one was not readily available based on economic feasibility.
