House Bill 1207 - Unemployment Compensation and Drug Testing

• Disqualifies individuals from unemployment benefits if they test positive on a drug test administered by a prospective employer after a job offer is made or as a condition of employment.

• Disqualifies individuals who refuse to submit to a drug test administered by a prospective employer in connection with employment.

• Requires prospective employers to immediately report positive drug tests or test refusals to the Department of Workforce Development.

• Allows disqualified individuals to regain eligibility by submitting a negative drug test to the department.

• Defines "drug test" as a minimum nine-drug panel testing for amphetamines, cocaine, opiates, barbiturates, cannabinoids, benzodiazepines, phencyclidine, methadone, and propoxyphene.
