HB 1236 Summary

• Allows the alcohol and tobacco commission to issue up to two new three-way permits for on-premises alcoholic beverage sales to restaurant proprietors in a town with population between 7,000 and 8,000 located within a historic district established by ordinance.

• Permits issued under this provision may not be transferred and are subject to auction conducted under IC 7.1-3-22-9 at any time determined by the commission.

• Applicants are ineligible for a permit if they sold a retailer's permit subject to quota provisions within two years before application for premises in the same district.

• If a permit is revoked or not renewed, the commission may issue a replacement permit as long as the total number of active permits does not exceed two at any time.

• Effective July 1, 2011.
