HB 1247 Summary

• Authorizes school corporations to adopt a school impact fee resolution imposing fees on new residential development to fund school infrastructure needs.

• Requires school corporations to prepare a capital projects plan including projected capacity needs for at least five years, estimated costs, project descriptions, funding sources, and construction schedules before adopting impact fees.

• Establishes fee caps: $1,000 per single-family unit, $750 per multiple-family unit with 4 or fewer units, and $500 per multiple-family unit with more than 4 units.

• Allows fees to be assessed up to 180 days after improvement location permit issuance or development plan submission, with installment payment options and appeals process through an impact fee review board.

• Requires fees to be used only for new school infrastructure identified in the capital projects plan and allows credits for developer-provided improvements, effective July 1, 2011.
