Defines "drug test" as a minimum five-panel test for amphetamines, cocaine, opiates, PCP, and THC, performed at a HHS-certified laboratory with DOT-certified collection, paid for by the employer.

Treats an individual as having refused suitable work if they test positive for drugs or refuse without good cause to submit to a drug test required by a prospective employer as a condition of employment.

Renders an individual ineligible for unemployment benefits when a job offer is withdrawn due to a positive drug test result or refusal to submit to drug testing.

Prohibits the Department of Workforce Development's records of drug test results from being admitted as evidence in criminal proceedings.

Effective July 1, 2011.
