HB 1389 Summary

• Amends Indiana Code to create a new chapter (IC 34-15-6) governing defamation actions involving interactive computer services, effective July 1, 2011.

• Defines "interactive computer service" as an Internet service, information service, system, or access software provider that enables computer access to servers used by multiple users, including Internet access services and systems operated by libraries, schools, and educational institutions.

• Makes each person responsible in whole or in part for creating or developing defamatory information posted or disseminated using an interactive computer service liable as a defendant in libel or slander actions.

• Establishes joint and several liability for all defendants, making each responsible for full damages awarded to the plaintiff.

• Applies only to causes of action that accrue after June 30, 2011.
