HB 1413 Summary

• Enacts an interstate compact requiring member states to distinguish on birth certificates and birth records between persons born subject to U.S. jurisdiction and those not subject to U.S. jurisdiction.

• Defines "subject to the jurisdiction of the United States" according to the Fourteenth Amendment as a child of at least one parent owing no allegiance to a foreign sovereignty, or a child without citizenship or nationality in any foreign country.

• Requires persons born subject to U.S. jurisdiction to be designated as "natural-born United States Citizens" on birth records.

• Compact does not take effect until Congress approves it under Article 1, Section 10, Clause 3 of the U.S. Constitution.

• Effective date: July 1, 2011.
