HB 1424 Summary

• Amends IC 13-20-2-11 to establish new conditions for solid waste landfill permit holders in counties that zone under IC 36-7-4

• Requires zoning authority review and approval of zoning appropriateness and legality before a permit holder can begin or complete landfill construction if: zoning approval was obtained more than 5 years before the operation permit was issued, the operation permit was issued more than 3 years before initial construction completion, and the facility did not lawfully accept waste for more than 8 years after zoning approval

• Mandates that zoning review must occur after at least 8 years have passed since local zoning approval and must comply with all applicable zoning laws existing at the time of review

• Becomes effective upon passage and declares an emergency for the act
