HB 1434 Summary

• Transfers township powers and duties to municipalities in townships containing one or more municipalities (excluding Marion County) effective January 1, 2013.

• Abolishes township board and township assessor offices on January 1, 2013, with their functions transferred to municipal fiscal/legislative bodies and county assessor respectively.

• For townships with multiple municipalities, each municipal fiscal body handles township functions within its municipality, while the municipality with the largest population also handles unincorporated township areas.

• Township trustees may continue exercising powers only in unincorporated areas after December 31, 2012, while municipal executives exercise trustee powers within municipalities.

• Requires the department of local government finance to adjust property tax levies, rates, and budgets of affected townships and municipalities to account for transferred duties and obligations.
