IN HB1459

Reclassifies incarcerated and lawfully detained persons as residents of their last known address before detention rather than the facility where they are held, for purposes of legislative and local government redistricting

Requires the Indiana Department of Correction to compile and submit demographic data on incarcerated persons by May 1 of each census year, including unique identifiers, facility addresses, and last known residential addresses

Directs county election boards to geocode incarcerated persons' addresses to census blocks and reallocate population counts accordingly within 30 days of receiving census geographic units

Establishes the office of census data within the legislative services agency to maintain an electronic database of adjusted population counts for use by the general assembly and political subdivisions in redistricting

Takes effect July 1, 2011, and applies to redistricting for state house and senate districts, county executive and fiscal body districts, municipal legislative bodies, and other population-based political subdivisions
