HB 1522 Summary

• Creates new Chapter 18 under IC 24-4 regulating the retail sale of smoking pipes and smoking devices, effective July 1, 2011.

• Requires retailers to store smoking pipes and devices either behind a counter in an area inaccessible to customers or in a locked display case requiring employee assistance for access.

• Prohibits the sale of smoking pipes and smoking devices to persons under 18 years of age.

• Defines "smoking pipe or smoking device" to include pipes made of various materials (metal, glass, ceramic, etc.), water pipes, carburetion devices, bongs, and related items.

• Establishes violation of these provisions as a Class A infraction.
