HJR 0008 Summary

• Proposes a new Section 38 to Article 1 of the Indiana Constitution regarding health care rights and opt-out protections.

• Prohibits persons, employers, and health care providers from being compelled to participate in any health care system, either directly or indirectly.

• Allows persons and employers to pay directly for lawful health care services without penalties or fines, and permits health care providers to accept direct payment without penalties or fines.

• Protects the right to purchase or sell health insurance in private health care systems subject to reasonable laws that do not substantially limit a person's options.

• Requires that health care system terms and conditions may not punish persons, employers, or providers for direct payment arrangements; does not affect required health care services, pre-2011 laws, or worker's compensation provisions.

• Requires agreement by two consecutive general assemblies and ratification by a majority of voters to become effective.
