SB 33 Summary

• Eliminates maximum statutory compensation period limits for surviving spouses of county police officers or county sheriffs killed in the line of duty, allowing benefits to continue indefinitely subject to other conditions.

• Surviving spouses receive worker's compensation benefits until the earliest of: remarriage, eligibility for non-disability benefits from Social Security or another tax-supported public employee retirement plan, or death.

• Applies retroactively to January 1, 2011, covering surviving spouses who began receiving compensation after December 31, 2010.

• Makes conforming amendments to worker's compensation statutes for both injury and occupational disease cases to implement the new survivor benefit provisions.

• Declares an emergency for the act's implementation.
