SB 35 Summary

• Requires every person arrested after June 30, 2011, for burglary, residential entry, a crime of violence, or a sex offense to submit a DNA sample to the arresting law enforcement agency.

• Allows expungement of DNA profiles from the Indiana DNA database if a person is acquitted of all charges, convicted and reversed with case dismissed, or case is dismissed without conviction.

• Increases the DNA sample processing fee collected by courts from $2 to $4 in criminal cases, infractions, and ordinance violations.

• Applies DNA sample requirements to persons on probation, home detention, community corrections placement, conditional release, or released on bond if they have not previously provided a sample.

• Takes effect July 1, 2011.
