Senate Bill 48 Summary

• Indiana Department of Transportation must provide written notice to county executives, municipal officials, fire protection providers, and emergency management directors before awarding contracts for state highway construction or improvement projects requiring closure for at least 5 consecutive days.

• Governmental bodies receiving notice may submit written objections within 30 days after notification, stating reasons for their opposition to the proposed highway closure.

• Department must respond to any written objections at a regularly scheduled meeting of the affected county board of commissioners, county fiscal body, or municipal fiscal body.

• Department may modify proposed projects to mitigate effects of highway closures, but all departmental decisions are final and not subject to judicial review.

• Effective date is July 1, 2011.
