Senate Bill 81 Summary

• Amends IC 3-8-1-2 to expand who can challenge a candidate's eligibility by allowing any registered voter of the jurisdiction conducting the election to file a challenge, rather than only registered voters of the specific election district the candidate seeks to represent.

• Requires the challenger to file a sworn statement with the election division or election board questioning the candidate's eligibility and setting forth the factual basis for the challenge.

• Allows the election commission or board to deny a candidate's filing if the candidate fails to meet constitutional or statutory requirements for that office.

• Prevents successive challenges to a candidate's eligibility if the same candidate was previously challenged on substantially the same grounds before nomination and a hearing was conducted.

• Effective July 1, 2011.
