Senate Bill No. 95 Summary

• Requires towing services to release passenger motor vehicles to owners or representatives upon receipt of written insurer agreement to pay charges and proof of vehicle ownership and registration.

• Eliminates statutory and possessory liens on vehicles once released by the towing service under these conditions.

• Obligates insurers to pay reasonable and customary towing charges plus interest at the rate specified in IC 34-54-8-5(b)(1), with interest accruing 31 days after vehicle release.

• Establishes requirements for towing services seeking insurer payment, including proper vehicle registration, financial responsibility, licensed operators, merchant certificates, secured storage lots, and public accessibility.

• Effective July 1, 2011.
