SB 98 Summary

• Amends IC 12-24-1-3 to add staffing and patient protections specifically for Logansport State Hospital

• Prohibits the Division of Mental Health and Addiction from reducing staffing levels below those in effect on July 1, 2010, unless authorized by statute

• Requires the division to fill vacancies created by employee terminations to maintain staffing at the July 1, 2010 level

• Mandates restoration of staffing levels to July 1, 2010 levels by October 1, 2011 if reductions have occurred, and restoration of cut programs if patient transfers necessitated those reductions

• Prohibits removal, transfer, or discharge of patients unless in the patient's best interest and approved by the patient/guardian, gatekeeper, and attending physician; this subsection expires December 31, 2012
