Senate Bill No. 104 Summary

• Amends Indiana Code to allow Barrett Law funding to finance mounds, guardrails, barriers, and other structures that limit child access to retention ponds or prevent vehicles from entering retention ponds.

• Expands eligible improvements under Barrett Law for both counties and municipalities to include retention pond safety structures.

• Permits works boards to assess all or part of lots within a platted subdivision for retention pond barrier improvements, in addition to existing assessment provisions.

• Allows property owners to pay assessments for retention pond improvements in installments with interest, consistent with other eligible improvement types.

• Effective date: July 1, 2011.
