Senate Bill 117 Summary

• Adds a new Class D felony offense for inflicting bodily injury on another person while committing or attempting to commit dumping controlled substance waste under IC 35-48-4-4.1.

• Creates a new Class B felony arson offense (Class A if resulting in bodily injury) for damaging property by fire, explosive, or destructive device while committing or attempting to commit dealing in methamphetamine or dealing in cocaine/narcotic drugs.

• Applies the new arson offense to damage to dwellings without consent, property endangering human life, property of another person valued at $5,000 or more without consent, or structures used for religious worship without owner consent.

• Effective date is July 1, 2011.
