Employees of counties, cities, towns, or townships are considered to have resigned from employment upon assuming an elected executive office or becoming an elected member of the unit's legislative or fiscal body, effective July 1, 2011.

Employees elected in the November 2011 municipal election and assuming office January 1, 2012, or those already serving in elected office on December 31, 2011, may complete their current elected term before the resignation requirement takes effect.

Employees may hold elected offices in units other than the unit that employs them without restriction.

Amends IC 36-1, IC 36-4, and IC 36-8 to make all existing provisions allowing government employees to hold elected office subject to the new restrictions in IC 3-5-9.
