SB 177 Summary

• Allows county jails and department of correction facilities to return unused medications meeting specified requirements to the dispensing pharmacy, with mandatory returns for Medicaid recipient medications and optional returns for other unused medications.

• Permits return of unused medical devices and medical supplies used for prescription drug therapy from correctional facilities to pharmacies under conditions established by rule.

• Authorizes pharmacists and pharmacies accepting returned medications, medical devices, or supplies to negotiate processing fees with correctional facilities and health facilities.

• Expands pharmacy rules to permit resale or reuse of unopened, unexpired medications and medical devices returned from county jails and correction facilities, provided they meet storage and packaging requirements.

• Effective July 1, 2011.
