SB 202 Summary

• Requires Indiana Department of Environmental Management (IDEM) approval before constructing or expanding satellite manure storage structures, anaerobic digestion facilities, and gasification facilities, with facilities on confined feeding operations obtaining approval through the confined feeding operation approval process.

• Exempts anaerobic digestion facilities and gasification facilities that use only biomass from regulation as solid waste processing facilities, but allows IDEM to regulate those using a combination of biomass and solid waste.

• Excludes manures and crop residues returned to soil as fertilizers or soil conditioners from the definition of solid waste, regardless of whether they are returned at the point of generation.

• Prohibits water pollution from fertilizer material in stormwater runoff and irrigation return flows resulting from land application at appropriate agronomic rates, provided documentation of compliance is maintained and requested by the department.

• Requires the state chemist to adopt rules by July 1, 2012 concerning staging, management, and land application of fertilizer materials, including standards to protect waters of the state.
