Senate Bill 221 Summary

• Legislative Services Agency must prepare a neutral summary of each proposed state constitutional amendment, not exceeding 200 words, and submit it to the Legislative Council for approval no later than 105 days before the election.

• If the Legislative Council does not approve the summary within the required timeframe, the original summary submitted by the Legislative Services Agency is automatically distributed and posted.

• Legislative Services Agency must distribute the summary to the election division, Indiana news media, and public libraries, and post it on the General Assembly's website no later than 60 days before the election.

• A copy of the summary must be posted at each polling place during the election where the constitutional amendment is submitted to voters.

• These requirements do not apply if the General Assembly has previously enacted legislation specifying the ballot language for the proposed constitutional amendment, and no legal action may be brought challenging the agency's discretion in preparing the summary.
