Senate Bill 230 Summary

• Establishes a rebuttable presumption that courts must order child transfers between parents to occur at a neutral location (other than either parent's residence) when both parents participate in the transfer and one or both have been arrested for or convicted of domestic violence.

• Defines "crime of domestic violence" for purposes of custody determinations by referencing IC 35-41-1-6.3.

• Applies the neutral location requirement to both child custody determinations under IC 31-14-14-6 and juvenile law proceedings under IC 31-17-2-8.4.

• Effective July 1, 2011.
