Senate Bill 290 Summary

• Prohibits abortion in Indiana except when a physician determines, based on sound medical practice, that abortion is necessary to save the life of a pregnant woman in a medical emergency.

• Creates a new Class C felony for anyone who knowingly, intentionally, or recklessly performs an abortion in violation of the prohibition.

• Removes all references to abortion clinics from Indiana Code, eliminating state licensing and regulation of abortion clinics under IC 16-21-2.

• Repeals existing abortion statutes including IC 16-34 and related sections governing abortion procedures and parental consent requirements.

• Effective date: July 1, 2011.
