Senate Bill 291 Summary

• Exempts firearms, firearm accessories, and ammunition manufactured in Indiana from basic materials and remaining within Indiana borders from federal regulation under interstate commerce authority, effective July 1, 2011.

• Excludes from the act crew-served weapons, firearms with bore diameter exceeding 1.5 inches using smokeless powder, fully automatic weapons, and ammunition with chemically explosive projectiles.

• Requires firearms subject to the act to be clearly stamped "Made in Indiana" on a central metallic part such as the receiver or frame.

• Declares that generic parts (springs, screws, nuts, pins) and basic materials (unmachined steel, unshaped wood) used in manufacturing are not subject to federal firearm regulation.

• Asserts state authority under the Ninth and Tenth Amendments to regulate intrastate commerce in firearms and cites the Second Amendment and Indiana Constitution Article 1, Section 32 as constitutional basis for the act.
