SB 302 Summary

• Prohibits employment of relatives of county, city, town, or township executives, legislative members, or fiscal body members by those local units effective July 1, 2011.

• Prohibits employment of relatives of other elected officers or employees in positions where that officer or employee would directly supervise the relative.

• Allows local units to contract with relatives of public officials or businesses they own if the official makes written disclosure under penalty of perjury and the unit approves in a public meeting, with disclosure filed to the state board of accounts and circuit court clerk within 15 days.

• Requires all public officials and elected officers to annually certify in writing under penalty of perjury their compliance with nepotism rules by December 31 each year.

• Grandfathers existing employees in non-compliant positions until January 1, 2015, and subjects unit executives to perjury prosecution and budget withholding by the Department of Local Government Finance for non-compliance.
